TERMS AND CONDITIONS OF USE

1. INTRODUCTION

This Terms and Conditions of Use ("Agreement") governs the use of Tiny Llama, an open-source AI Home Server plugin platform developed by InsightReactions ("We" or "Us"). By using Tiny Llama, you agree to be bound by these terms.

2. DEFINITIONS

• "Software" means the software, firmware, operating systems, and any other digital content provided with or used in conjunction with Tiny Llama.
• "User" means an individual who uses Tiny Llama for personal or business purposes.
• "Update" means a modification or patch to the Software that improves its performance, functionality, or security.
• "AI Plugin" means any software or code developed by third-party developers and integrated into Tiny Llama to provide additional features or services.

3. OWNERSHIP AND LICENSE

The Software is open-source, and by using Tiny Llama, you are granted a limited license to modify, distribute, and create derivative works based on the Software, subject to the terms of the applicable open-source license.

4. SOFTWARE UPDATES

We deliver updates for the Software automatically, but require your manual confirmation before installation. By clicking "update", you confirm that you wish to receive and install the system update from InsightReactions.

While we strive for a seamless updating experience, please note that remote updates may temporarily impact device usability. In such cases, technical assistance may be necessary to restore normal functionality.

5. HANDLING FAILED SOFTWARE UPDATES

If an update fails, please save the error log and email it to support@insightreactions.com, along with your stated hardware platform (Genuine Tiny Llama AI Home Server, or other). Our team will provide guidance on troubleshooting and do our best to resolve the issue.

For users of unaltered and unmodified Tiny Llama AI Home Servers, if the software update procedure is determined to be at fault and cannot be resolved remotely, we offer a complementary repair service upon request (shipping costs may apply). Please refer to the InsightReactions Store Return Policy for more information.

For users that are not utilizing a Genuine Tiny Llama AI Home Server, the usage of the Tiny Llama software and features contained therein is at your own risk.

6. USER DATA COLLECTION AND USE

Tiny Llama does not collect user data but may host third-party AI Plugins that do. Before installing and using any AI Plugin from the Tiny Llama Plugin Marketplace, please consult each respective privacy policy to understand how each AI Plugin handles your data.

7. WARRANTY AND SUPPORT

InsightReactions provides its products "AS IS" without warranty, except as specified below.

For purchases of our AI Home Server, we offer a 30-day money-back guarantee, allowing you to evaluate the product risk-free. Additionally, component manufacturers may provide limited hardware warranties for certain components. Upon request, we will provide detailed information on individual warranty terms and limited repair services available to support your Tiny Llama AI Home Server.

You are responsible for ensuring that our products meet your specific needs and are compatible with your systems, devices, and infrastructure before making a purchase.

8. LIABILITY AND INDEMNIFICATION

• Limited Liability (Tiny Llama AI Home Server): We will not be liable for damages arising from the use of the Tiny Llama AI Home Server, except in cases where we have acted with gross negligence or intentional misconduct.
• Indemnification (Tiny Llama Software): You agree to indemnify us against any claims, damages, or expenses arising from your use of the Tiny Llama Software, provided that such claims, damages, or expenses arise solely out of your use of the Software and not out of your use of the Tiny Llama AI Home Server.

9. GOVERNING LAW AND JURISDICTION

This Agreement will be governed by and construed in accordance with the laws of the State of Utah, United States of America, without giving effect to any principles of conflicts of law. Any disputes arising from this Agreement will be resolved through arbitration in Salt Lake City, Utah, as further described below.

10. CHANGES TO THE AGREEMENT

We may modify this Agreement from time to time, and your continued use of Tiny Llama after being notified of a change constitutes acceptance of the revised terms.

11. ENTIRE AGREEMENT

This Agreement represents the entire understanding between you and us, supersedes all prior negotiations, understandings, or agreements, and is binding upon both parties.

12. DISPUTE RESOLUTION

Any disputes arising from this Agreement will be resolved through arbitration in accordance with the rules of the American Arbitration Association ("AAA") then in effect. The arbitration will take place in Salt Lake City, Utah, USA. Judgment on any award rendered by the arbitrator may be entered in any court having jurisdiction over the parties.

By using Tiny Llama, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement.
